If you have an agency work employment contract phase A with agency clause, the following is applied: ‘no work, no salary’ (see article 40, section 1 t/m 4 of the ABU-CAO). It is important that the exclusion of the continued payment of wages is included in the written agency work employment contract. If there is no work, the salary will not be paid.
For phase A without agency clause, phase B and C, a continued payment of wages for the agreed contract hours is applied. If you cannot work due to the closing of the company, this lies in the sphere of risk of the employer, so the salary will be paid. Charlie works will offer you substitute employment (see article 44 of the ABU-CAO).
