The phase system applies if you are sent for work to a client by an agency for temporary workers. In the Netherlands, this phase system can only be applied by temporary employment agencies. A regular employer works with the chain system, whereby you can get three conracts in three years (until January 1st, 2020 three contracts in two years) before you start working fora an indefinite period.

Phase A with agency clause
You usually start at the beginning of your employment in phase A. This phase lasts 78 worked weeks. In phase A, you work with an agency work employment contract with agency clause, unless a secondment agreement is concerned.
An agency work employment contract with agency clause ends:
- when the assignment on which you work at the client is terminated by the client;
- when you are sick;
- when you have reached the state retirement age;
- when you want to stop the assignment by yourself.
Before the end of phase A, you will be informed whether you are eligible for a phase B labor contract.
This is a second agreement for a definite period. A second agreement in phase A always ends automatically when the end date has been reached. At the latest one month before the second agreement ends, we will inform you whether your contract will be extended. This depends on your employability, skills, performance and ambitions to further developping.
In phase B you can get a maximum of six contracts in four years. Phase C follows after these four years of phase B or after six active contracts.
At least one month before the end of your final phase B contract you will be informed by us whether you can move on to phase C (a contract for a indefinite period). During the phase B periode there have been several evaluation moments with you. So we will have a good picture of whether you would like to continue working for us and whether we can continue to offer you sufficient work. Here also your skills, employability and ambition shown play an important role in decision making.
